Courts MAY NOT implement a non-rivalry or non-requesting proviso if: the provision could be damaging to people in general (for example in the event that it could discourage the neighborhood economy); the provision is more extensive than should be expected to ensure the business; the provision would cause undue difficulty on the worker (for example it would make it hard for the worker to discover new business); or the proviso has outlandish time and geographic limitations.
